Statutory Will

It is important that everyone makes a Will to ensure that their personal possessions, money and property passes to the people they would like it to pass to.

Unfortunately, circumstances can arise where an individual loses mental capacity before they have had an opportunity to make a Will. This means that the individual cannot make a Will in the normal way because they do not have mental capacity that is required to validly effect a Will.

In these circumstances, a Statutory Will can be made on behalf of the individual. It will take into account the individual’s wishes, tax implications and views of family and friends. It will be necessary to apply to the Court of Protection for approval. We can assist you during this difficult time to prepare a Statutory Will and get it approved by the Court.
