The law reform body has recommended the introduction of financial needs guidance and ‘qualifying’ prenups.

This has been threatened for some time now. With the complexities of family relationships it will be difficult for a formulae to be fixed to deal with potential outcomes. It may assist the average earner but I still believe it is not going to dry up matrimonial work in the future. I think family lawyers will welcome some further guidance on possible settlements as the current legislation – Section 25 Matrimonial Causes Act 1973 is very vague and at best very unhelpful.

Hopefully the introduction of a formulae will give lawyers the opportunity to give much more focused advice than we feel we can at present.
