Employees with 2 years' continuous employment are entitled to a statutory redundancy payment if they are dismissed by reason of redundancy.

The amount of statutory redundancy pay to which an employee is entitled depends on their age, length of service and pay.

  1. Redundancy payments are calculated on employees age and number of years worked.
  2. The number of years' service is calculated as at the date of termination of employment. If the employee is paid in lieu of notice, the relevant date is the end of the notional notice period i.e. the date to which they would have worked if the employer had given the notice required by statute this is after one month an amount equivalent to one week for each year of continuous service up to a maximum of 12 weeks notice for 12 or more years service.
  3. Age is calculated as at the end of the notice period.
  4. In the case of employees over the age of 64, the amount payable is reduced by one twelfth for each month by which her or his age exceeds 64.
  5. Employment prior to the 18th birthday does not count.
  6. Employees, who have attained the normal retiring age, provided that there is such an age in the business, that is less than 65 and that is the same for men and women, are not entitled to a redundancy payment.
  7. Where there is no normal retiring age employees who have attained the age of 65 are not entitled to a redundancy payment.
